TERMS OF USE These Terms of Use set forth the rules governing the use of the official Tu Futuro program ("Tu Futuro") web site at www.tufuturofinanzas.com which is referred to herein as the "Site". By accessing the Tu Futuro site or placing a Tu Futuro link on your site, you (the "User") automatically agree that you have read, understand and agree to be bound by these Terms of Use ("Terms of Use" or "Agreement"), whether or not you are a registered member of the Site. If you do not agree to the terms and conditions set forth in this agreement, you should immediately discontinue all use of this site. We reserve the right, at any time, to modify, alter or update the terms and conditions of this agreement without prior notice. Modifications to the agreement will take effect at the time they are posted on the official Tu Futuro website. For the purposes of these Terms of Use, a User is any person who enters the site for any reason whatsoever, regardless of whether or not such User has registered on the site. An active user is considered a "Member" of the Tu Futuro community once he or she has completed any of the registration forms on the site. A user includes the person and any legal entity that is represented by such person under actual or apparent authority that is using this site.

Service Description Tu Futuro provides the member and user access to resources and different tools focused on financial education. The information offered directly by Tu Futuro has no cost, some tools or services offered by third parties will have some cost. In both cases it is clearly communicated in order to avoid confusion. TU FUTURO services have NO HIDDEN COSTS. All products or services listed on or through the Site and all transactions conducted in connection with the Site, such as marketplace listings offered free of charge to users of Tu Futuro, are subject to and governed by the following rules (the “Rules”) as well as these Terms of Use.

Standards

Participants in the transaction are fully responsible for all interactions that occur between the parties, for the payment arrangements and exchange of products or services purchased if any, and for the results and performance of any relationship or transaction created through the Hispanic Chamber of E-Commerce electronic marketplace within the United States Business Association of E-Commerce (“USBAEC”) portal. You acknowledge that USBAEC IS NOT LIABLE for the action or inaction of any party to a transaction, for any failure to perform, to pay debts, or for the delivery of a product or service under the conditions promised, or for any other aspect related to a transaction.

USBAEC reserves the right to limit, deny or create different access to the site and its services with respect to different users, or to change any of the services/features of the site or to introduce new ones.

USBAEC may suspend or terminate the account of the member or user to whom such information was improperly transferred in the event of a sale, offer for sale, gift, assignment or transfer as a result of a violation of this section.

Some of the content displayed on the Site is provided or posted by third parties (“third-party content”). USBAEC is not the intellectual author of third party content, whether contributed by anonymous users or paid for by content providers. Neither USBAEC nor any of our affiliates, directors, officers or employees has established a business relationship with any sales agent that links them to any third party as a result of third party content that is displayed on our Site. Any third-party content displayed on the Site is entirely the responsibility of the party providing it. USBAEC is not responsible for the truthfulness, appropriateness, relevance, legality or accuracy of third party content, and will not be responsible for responding to users on any point relating to third party content. Further, USBAEC is not responsible for the conduct of users within the Site, and shall not be liable for any damages suffered by any person as a result of the conduct of users within the Site.

Disclaimer of Warranties

The site is provided by Tu Futuro on an “as is” and “as available” basis. To the fullest extent permitted by law, Tu Futuro makes no representations or warranties of any kind, express or implied, regarding the use or the results of this Web site in terms of its truthfulness, accuracy, reliability, or otherwise. Tu Futuro shall have no liability for any interruption in the use of this Web site. Tu Futuro disclaims all liability in connection with the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply.

Limitation of liability

USBAEC Member Account

All members of the service will receive an account and password. Members are fully responsible for any and all activities that occur under their use of their account, whether authorized or unauthorized. The member agrees to notify USBAEC of any unauthorized use of their account or any other breach of security known or should be known to the member. Member’s right to use the Service is personal to Member. Member agrees not to resell or make any commercial use of the service without the express written consent of USBAEC.

Modifications and interruption of service

Tu Futuro reserves the right to modify or discontinue the Service with or without notice to members and users. Tu Futuro shall not be liable to you or any third party should Tu Futuro decide to exercise its right to modify or discontinue the Service. Member acknowledges and agrees that Tu Futuro does not guarantee continuous, uninterrupted or uninterrupted access to our website and that the operation of the website may be subject to interference or adverse effects caused by numerous factors or circumstances beyond our control.

Third Party Sites

Our Web site includes links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third party site. Tu Futuro makes no warranties or representations whatsoever in connection with any product offered or provided by a supplier, and you acknowledge that any reliance on any representations and warranties provided by a supplier shall be at your own risk.

Jurisdictional administration of the courts of CALIFORNIA

Our company is incorporated in the State of California, which conducts its business as the HISPANIC CHAMBER OF E-COMMERCE. As such, they are subject to the laws of the State of California, and those laws will govern the Terms of Use, without giving effect to any choice of law rules. We make no representation that our Web site or other services are appropriate, legal or available for use in other locations. Therefore, if you choose to access our site you agree to do so subject to the internal laws of the State of California.

Compliance with laws

Member and user assumes all knowledge of applicable laws and is responsible for compliance with any such laws. Botnets

Tu Futuro reserves the right, at our discretion, to terminate all accounts related to botnets and related activities. If any of the hostnames are used as command and control botnet points, Tu Futuro reserves the right to direct the hostnames involved to a honeypot, loopback address, facility, or any other destination at its sole discretion.

Other Conditions

If any provision of these Terms of Use shall be unlawful, void or unenforceable for any reason, the remaining provisions (and any enforceable portion thereof) shall not be affected thereby and shall remain valid and enforceable to the fullest extent possible. You agree that these Terms of Use and any other agreements referred to herein may be assigned by Tu Futuro, at our discretion, to a third party in the event of a merger or acquisition. In addition, these Terms of Use shall apply to, and shall not be superseded by, any other written agreement between us in connection with your participation as a member or user.
